The purpose of the present study was to profile high school students’ achievement as a function of their demographic characteristics, parent attributes, and school behaviors. Students were nested within schools in the Saudi Arabia Kingdom. Out of a large sample of 500k, participants involved 3 random samples of 2,000 students measured during the years 2016, 2017, and 2018. Randomization was conducted at the student level to ensure that all school units will be represented and at their respective frequency. Students were (...) nested within 50 high schools. We adopted the multilevel latent profile analysis protocol put forth by Schmiege et al. and Mäkikangas et al. that account for nested data and tested latent class structure invariance over time. Results pointed to the presence of a 4-profile solution based on BIC, the Bayes factor, and several information criteria put forth by Masyn. Latent profile separation was mostly guided by parents’ education and the number of student absences. Two models tested whether the proportions of level 1 profiles to level 2 units are variable and whether level 2 profiles vary as a function of level 1 profiles. Results pointed to the presence of significant variability due to schools. (shrink)

The purpose of the present study was to predict and explain the academic cheating behaviors of elementary school students with learning disabilities by applying the cusp catastrophe model. Participants were 32 students with identified LD from state governmental agencies although all both them and the typical students participated in the experimental manipulation. Academic cheating was assessed using an empirical paradigm where true achievement was subtracted from achievement in a test without proper invigilation. Data analysis supported the proposed cusp catastrophe models, (...) where mastery-related motives acted as asymmetry and performance goals as bifurcation variables respectively. These findings were confirmed with application of the interactive goal hypothesis, where the interactive approach and avoidance performance goal term functioned as a splitting factor in the relationship between adaptive motivation and performance. The purpose of the present studies was to evaluate and predict academic cheating with regard to a national examination in a Middle East country. In Study 1, 4,024 students took part and potential cheaters were classified as those having discrepant scores in multiple administrations that exceeded 1 SD in absolute terms. A latent class mixture analysis suggested two pathways for potential cheating: (a) The first path involved students—most male—who changed city or region of examination during test taking, and (b) the (...) second path described students—most male—who did not change city, region, or center of administration. Study 2 profiled cheaters using a sample of examinees who were actually caught cheating. Participants were 545 students, 253 of whom were caught cheating between 2002 and 2012. Both samples were selected from a pool of 319,219 testees using random sampling procedures. Results indicated that a 4-class solution best fitted the data as in Study 1. Furthermore, a predictive model was tested with an independent cross-validation sample of 112 examinees (56 cheaters, 56 noncheaters). Results indicated that the model classified correctly 78.57 of the new cheating cases (sensitivity) and 94.64% of noncheaters (specificity). (shrink)

Temporal Type Theory (TTT) has been recently introduced as a topos-theoretic approach to understanding the behaviour of systems over time. A truly innovative point of TTT is that it makes truth inherently dependent on time; this is to be contrasted with the classical approach in which past, present and future are related via logical operators. Further on this line of research, the notion of truth is substituted by the ‘time duration’ over which a proposition is true, giving rise to the (...) logic of temporal landscapes. In this paper, we embed the main notions of the Calendar and Time Type System (a framework that was built for reasoning about calendric notions in the context of the Web and is centred around the notion of time granularity) in Temporal Type Theory, attempting to address a common requirement in the practical use of temporal formalisms: the ability to speak about certain time moments and appropriate time windows in (past and future) time, in the form of hours, dates, holidays, etc. With a view to concrete applications, we provide examples on how calendar types can be combined with temporal operators of TTT to augment the expressive power of this framework. In that respect, the addition of calendar types genuinely adds to the range of Temporal Type Theory as a powerful specification language. (shrink)

Action can only be spontaneous and impulsive if not guided by contemplation; contemplation, on the other hand, may only be luxurious playfulness if not either purposed - or suitable - to motivate action. This volume seeks to prove what may seem self-evident to common sense, but adhering to common sense is never pointless nor excessive. Next to this, Thinking in Action is the offspring of friendship, respect and commitment between two academic communities, the Hellenic and the Serbian philosophical communities, that (...) admittedly have a lot in common, especially with regard to philosophy, and hopefully as many differences as needed in order to secure a long-lasting and fertile exchange of ideas; it is also the natural-born child of necessity: philosophy is about argumentation, debate and confrontation. Thinking in Action inaugurates Hellenic-Serbian Philosophical Dialogue Series that entertains no hesitation in being as ambitious as any philosophical series could be: it seeks to establish a permanent, wide and rich channel of fruitful philosophical interaction between the two philosophical communities. Having high aspirations is one thing; meeting these aspirations as well as the expectations of the reader is a totally different one. We wish Thinking in Action, the first volume of the Hellenic-Serbian Philosophical Dialogue Series, apart from being the initial step of a long journey, will also be a fascinating one to the reader. This paper inquires into the inability ofsubjects in English to topicalise. Treatingtopicalisation as a specific case of d-linking,it asks: why don’t subjects topicalise inEnglish? And why cannot they be d-linkedthrough further movement? It concludes thatthe property of [aboutness] of subjects is anunderspecified instance of a more compositederivative effect realised as [topic]. Giventhe ability of objects in English to be readilyd-linked through extraction in CP, theanalysis takes a detailed look at the structuraldifferences between subjects and objects. Itconcludes that d-linking of an (...) argument iscontingent upon the derivational memory ofits prior inclusion within vP that has yielded itsdenotational set-membership. Treating EPPas an A’-operation that embeds one instance ofthe subject-chain into discourse, the inabilityof subjects to topicalise is explained as an “online”denotational dependency on discourse,which lacks the systemic memory of thesubject’s embedding. In turn, their immobilityis treated as a modular dependency betweenthe two subject copies, mediated through Texcluding the one instance of the chain. (shrink)

Modernity and Contemporaneity is the 3rd volume in the Hellenic-Serbian Philosophical Dialogue Series, a project that was initiated as an emphatic token of the will and commitment to establish permanent and fruitful collaboration between two strongly bonded Departments of Philosophy, this of the National and Kapodistrian University of Athens, and that of the University of Novi Sad respectively. This collaboration was founded from the very beginning upon friendship, mutual respect and strong engagement, as well us upon our firm resolution to (...) establish a solid continuity in the editing project. A large literature documents the correlates and causes of subjective well-being, or happiness. But few studies have investigated whether people choose happiness. Is happiness all that people want from life, or are they willing to sacrifice it for other attributes, such as income and health? Tackling this question has largely been the preserve of philosophers. In this article, we find out just how much happiness matters to ordinary citizens. Our sample consists of nearly 13,000 members of the UK and US (...) general populations. We ask them to choose between, and make judgments over, lives that are high in different types of happiness and low in income, physical health, family, career success, or education. We find that people by and large choose the life that is highest in happiness but health is by far the most important other concern, with considerable numbers of people choosing to be healthy rather than happy. Le corps a toujours été marginalisé au profit de la notion de l'âme. Pendant que les penseurs ont été intéressés par l'étude de l'âme, le corps a toujours été leur point de départ. Son statut éthique et ontologique doit être réexaminé en refusant de se limiter aux dualismes classiques corps/âme ou matérialisme/spiritualisme qui masquent par leur dimension formelle ou (...) réductrice l'enjeu politique et existentiel de la question ainsi que ses implications théoriques et pratiques. Deux grandes perspectives apparaissent dans le développement de la falsafa lorsqu'elle problématise la question du corps. La première porte sur le fondement psychologique du lien existant entre l'âme et le corps et ses conséquences quant à la détermination de leur valeur réciproque. La deuxième est métaphysique et s'inscrit dans une visée eschatologique impliquant une conception de l'au-delà et du jugement dernier. Comment penser le corps d'un point de vue philosophique pour qu'il ne soit pas incompatible avec l'islam? Pour répondre à cette question, nous étudions les textes fondateurs de la falsafa spécialement ceux de Al-F r b, Ibn S n, Al-Ghaz l et Mull Sadr tout en les comparant aux textes coraniques. The article focuses on an unexamined so far aspect of byzantine philosophy, namely the influence of Arabic philosophy upon byzantine thinkers. Despite the vicinity of Byzantium and Arabic territories, the philosophical interactions were minimal. Scholarios claimed, in a dedicatory epistle to Constantine Paleologus (1405-1453), that he had studied the treatises of Avicenna, Averroes, and other Arab and Persian philosophers. He admitted that Averroes was beyond doubt the best commentator of Aristotle. Scholarios acknowledged that the study of the Arabs contributed immensely (...) to his philosophical education and particularly to the proper understanding of the Aristotelian philosophy (Scholarios, vii.1-6). Scholarios aimed at the enrichment and renewal of Byzantine philosophy. Besides his high esteem for Arabic philosophy, he devoted a large part of his life translating and paraphrasing the Scholastics, especially Aquinas. Despite Scolarios’ claim about his erudition on the Arab and Persian philosophers, a detailed examination of his works proves that in most cases he simply reproduced and incorporated sections from Aquinas’ works, without resorting to the original sources. Scholarios’ references to the Arabs are multiplied in his translations and compendia of Aquinas’ works, but are reduced significantly in his original texts. Frequently Scholarios refrained from mentioning the Arab philosophers, despite the fact that he commented on Aquinas’ passages, which are dedicated to Avicenna or Averroes. On the contrary, Scholarios did not avoid mentioning in detail Aquinas’ Christian or ancient Greek sources. It is obvious that Scholarios did not have a consistent approach towards Arabic philosophy. Most of the times he reproduced loosely Aquinas’ passages, where the latter commented on the Arabs. (shrink)

In this article the impact of the dialogue Peri Politikis Epistimis in the political philosophy of the first Arab philosophers is highlighted and analyzed. This dialogue, whose importance was pointed out relatively recently in the relevant literature, contains material that guides the researcher to understand in a different way the intake not only of the classical but also of the early Byzantine political philosophy by Al-Farabi. The text focuses on the handling of the relationship between politics, religion and heresy in (...) the early Byzantine treatise and in the work of Al-Farabi, an issue that has not been dealt with thoroughly by modern research. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. The problem of economic justice is the division and distribution of income and wealth. Is a just distribution an equal distribution, or are some unequal distributions just, and if so which ones? We critically examine what the ideal theories of justice of Aristotle and Rawls say or imply about a just distribution of wealth and income in the best of circumstances. Rawls’ contractarian view takes strict equality to be the benchmark of justice; Aristotle’s teleological theory claims that the equality appropriate (...) to distributive justice is proportional, equality of ratios among persons’ shares of a good and their respective merits for that good. The applications of the two theories result in different distributional outcomes. Aristotle’s justice principle will result in unequal outcomes if the merits of persons are unequal and in equal outcomes if the merits are equal. An example of the latter is his best polis and constitution--its ideal citizens will have superlative and equal merits and they will justly receive equal political and economic shares. Although he supports reducing economic inequalities in actual cities, serious inequalities in resources will remain. Rawls’ basic principle of justice will produce equal shares. But democracies allow great inequalities in wealth and income, presumably recognizing that some inequalities promote the common good; everyone is better off when some economic incentives are rewarded. But which economic inequalities are just? Rawls in his second principle of justice identifies the most widely held way of answering this question. (shrink)

This article analyses the articulation of the relationship between ‘patriotism’ and ‘cosmopolitanism’ or commitment to ‘humanity’ in the writings of some major Victorian political thinkers. It is argued that: (a) there was no neat distinction between ‘patriotism’ and ‘nationalism’ in the thought of the time; (b) ‘patriotism’ was seen as a stepping stone to universalistic commitment to ‘humanity’ rather than as opposed to or incompatible with the latter; (c) most thinkers avoided the term ‘cosmopolitanism’, because of some of its associations, (...) and preferred to use love of ‘humanity’ or similar terms to refer to universalistic commitments; (d) all thinkers discussed here believed that some form of ‘patriotism’ was necessary, while all of them complained that the term was being misused by most of their contemporaries and inveighed against some misconceived and morally reprehensible version of ‘patriotism’; and (e) most discussions of patriotism and universalism were conducted in a religious or quasi-religious language. The main focus of this article is on John Stuart Mill (1806-73), Matthew Arnold (1822-88), Herbert Spencer (1820-1903), Thomas Hill Green (1836-82), Henry Sidgwick (1838-1900), Frederic Harrison (1831-1923) and, to a lesser extent, Frederick Denison Maurice (1805-72), John Robert Seeley (1834-95) and Charles Henry Pearson (1830-94). This is a translation of an article published in the journal Argeiaki Ge, which was asked from me by the scientific journal Journal of Classical Studies Matica Srpska. The Argive Hapocration was a philosopher and commentator from the second century A.D. His origin is not disputed by any source. However, there is still a potential possibility that he might have descended from a different Argos: namely that which is in Amfilochia, Orestiko or that in Cyprus. Yet, the absence of any (...) additional geographical designation in his name in ancient sources is likely to disprove such claims. Simply mentioning ‘Argos’ can only indicate the most notable of the cities with this name, namely the Argive Argos. As will be revealed later in this paper, the close relationship between Hapocration with the Atticus family may well support his Argive origin. I support that it is obvious to assume that there is a close affinity of philosophical activity in Phlius and in Argos which remains to be investigated in more detail in the future. The research of written and archaeological sources can flourish further still. I hope that in the near future there will be evidence enough for a fuller presentation of philosophical activity in ancient Argos. (shrink)

Main figures in Byzantium after the Byzantium were Ioannis Zygomalas (1498-1584) and his son and fellow Theodosius (1544-1607) who drew a spiritual path that left many and rich traces and presumptions. They served in the Patriarchate of Constantinople in key positions. There they taught the ancient Greek language and they copied and distributed manuscripts of works of ancient and byzantine writers. Their mailing correspondence with European scholars and travelers is well known. Thanks to that, the humanistic Europe met not only (...) the Greek scholars of the 16th c. but also their spoken language of that era, as a continuation of the Greek classical times and the Byzantine world. Background: Respecting patients’ dignity has been described as a fundamental part of nursing care. Many studies have focused on exploring the concept of patients’ dignity from the patient and nurse perspective, but knowledge is limited regarding students’ nursing perceptions and experiences. Objective: To explore the issue of patients’ dignity from the perspective of nursing students. Research design: A qualitative study was employed with the formation of four focus groups and the participation of nursing students. Data were analysed via a thematic (...) content analysis of the discussions. Participants and research context: Thirty-four nursing students of a Cyprus University participated in the four focus groups. Each group was homogenous in terms of the year of study and heterogeneous in terms of clinical practice in various wards. Ethical consideration: The study’s protocol was reviewed and approved by the Cyprus National Bioethics Committee. Ethical standards were followed throughout the study. Findings: Several factors that maintain or compromise patients’ dignity emerged. These factors were grouped into five themes: (a) patients’ preferences, verbal abuse and regarding a patient as a unique person; (b) privacy and confidentiality; (c) loss of autonomy and need for help; (d) discrimination and (e) attribution and reciprocity. Discussion: Different understandings of the perceived concept of dignity and the factors that maintain or compromise patient’s dignity were expressed through the eyes and the feelings of nursing students. Students highlighted the importance of promoting patient dignity as an important component of nursing care. Conclusion: Nurse educators can use the findings of this study in order to tailor nursing programmes to emphasise the importance of respecting patients’ dignity. In addition, nurse ward managers can use the findings as means for persuading nurses to change current behaviour. (shrink)

This commentary is a critical appraisal of Gil-Pérez et al.'s (2002) conceptualization of constructivism. It is argued that the following aspects of their presentation are problematic: (a) Although the role of controversy is recognized, the authors implicitly subscribe to a Kuhnian perspective of `normal' science; (b) Authors fail to recognize the importance of von Glasersfeld's contribution to the understanding of constructivism in science education; (c) The fact that it is not possible to implement a constructivist pedagogy without a constructivist epistemology (...) has been ignored; and (d) Failure to recognize that the metaphor of the `student as a developing scientist' facilitates teaching strategies as students are confronted with alternative/rival/conflicting ideas. Finally, we have shown that constructivism in science education is going through a process of continual critical appraisals. (shrink)

Συζητούνται οι διαφορές και προτείνεται μια νέα υπόθεση : τ]φ 'Ρωγών ποταμω.

According to LAMPAKIS (L.), the main purpose of this book is to offer a detailed biography of Georgios Pachymeres as well as an assessment of his works (p. 9). Unfortunately, it falls far short of achieving either of these objectives. First, the choice of wording – “Introductory essay” – in the title is somewhat infelicitous. The meaning of “essay” in modern Greek is vague, to say the least, and few would apply this term to a book which, in essence, is (...) an unnecessarily long compilation of the known facts about Pachymeres' life and works. Only an attempt by the author to interpret the thought of Pachymeres or to place his work in the broader historical context of his times would have convincingly justified the term “essay” for this particular monograph. L ’habitat de Krisa, fouillé en 1935‑36, a livré d’importants vestiges de l’âge du Bronze. Le réexamen du site et du mobilier a pour but de revoir l’accessibilité de l’éperon rocheux, de redater les dépôts céramiques découverts dans les bâtiments et les tombes au sein de l’habitat, ainsi que de mettre à jour nos connaissances sur le corpus céramique. On démontre, entre autres, que la porte ouverte dans le mur de fortification se trouve plus à l’Est que l’emplacement indiqué jusqu’alors. (...) De plus, la phase HR I de l’habitat était plus importante que ce qui avait été supposé, alors que la phase HR II A demeure difficile à identifier. Par ailleurs, on souligne la présence récurrente de vases à boire et vaisselle de table dans le corpus céramique mycénienne. Enfin, on soutient que la majeure partie des céramiques à peinture mate et mycénienne examinées a certainement été produite régionalement. (shrink)

Stamnos no. 5898 of the 3rd Ephorate of Prehistoric and Classical Antiquities has been restored from fragments which were found in an ancient well together with a large number of other broken vases during the course of an excavation on the site of no. 12 Ayiou Georgiou Karytsi at the corner of Praxitelous street. The foot and a number of fragments are missing, but the main décoration is complète. A meander encircles the vase, marking the line of the ground in (...) the scenes of the principal décoration. There is a tongue motive on the shoulder, a frieze of ovoli on the outside bevel of the lip, and a plant ornament on the handles. Both sides of the vase carry the representation of a warrior. The one on the principal side is turned to the left; he wears an Attic helmet and greaves and holds a lance in his right hand and a shield in his left; to the right of the shield a meaningless inscription can be read: MNONE. The second warrior is turned to the right; he wears a himation and holds a lance in his left hand and a Corinthian helmet in his right; he is accompanied by a dog who precedes him; to the right of the lance can be read: Ν Ο EN Δ Ν Ι. The drawing of the two scenes is carefully executed, with great attention to detail. On the principal side of the vase, the painter has depicted a warrior leaving for battle determined to win, and the second side shows the hero of the Median Wars. In view of the proportions of the vase, we would assign it to the class of the Louvre Kaineus Stamnos. The artistry and style of the drawing has similarities with the work of the Brygos Painter. The meaningless inscriptions, found on other works by the painter and probably serving as commercial brand marks, lend added support to this identification. The proportions, plant decoration and above ail the drawing, date the vase to 480 BC, between the artist's middle and final periods. The Athens stamnos no. 5898 is ail the more precious since Greek museums possess only a limited number of stamnoi, few works by the Brygos Painter and to date no other stamnos that has been attributed to this painter. Seine Schriften, eine von POLEMIS (P.) als „Appellatio“ bezeichnete Beschwerde über die Voreingenommenheit des Ioannes Kantakuzenos auf dem Konzil von 1351, zwei Briefe und ein von P. so genannter „Tractatus brevis de Christo ipso splendente in Transfiguratione“ sind anonym überliefert, zudem auch ohne Überschriften. Zu Beginn der Einleitung wird G. (...) MERCATIs Annahme, daß die Schriften von Dexios verfaßt wurden, gegen J. MEYENDORFF, der sie dem Arsenios von Tyros zuwies, überzeugend verteidigt. Der Autor des 1. Briefes vertrat die merkwürdige Meinung, daß das Thaborlicht mit dem menschlichen Körper Christi identisch gewesen sei (XVI). Diese Ansicht kritisierte Isaak Argyros in seinem Brief an Gedeon unter Namensnennung des Dexios, wie Mercati bereits feststellte (XXIII f.). Daß die genannten Schriften, die teils in Vat. Gr. 1111, teils in Vat. Gr. 1823 überliefert sind (XIII), auf denselben Autor zurückgehen, ist daraus zu erschließen, daß der Schreiber von Vat. Gr. 1823 in Vat. Gr. 1111 Autorenkorrekturen vornahm (XV f.). Ein wichtiger Punkt der Widerlegung Meyendorffs besteht auch darin, daß dieser die Worte des Dexios, die sich auf den Schluß des vom „seligen Gregoras“ inspirierten Glaubensbekenntnisses der Antipalamiten im Jahr 1351 beziehen, nämlich „an letzter Stelle war in ihm (dem Bekenntnis) folgendes zu lesen: ‚Hinsichtlich des Kalabrers Barlaam und des Akindynos sagen wir, daß wir damit einverstanden sind, was die heilige Kirche Gottes entschieden und festgelegt hat‘ (220), indem wir auf unseren Patriarchen verwiesen“, auf Ignatios von Antiochien, den Vorgesetzten des Arsenios, bezog, dieser schmähliche, wenn auch wohl postume Verrat an Akindynos (so unsere Meinung) aber laut P. eine Anerkennung des Tomos von 1341 bedeutet, mit dem Patriarchen demnach Kalekas gemeint ist (XX f.). P. weist nach, daß der Brief des Dexios, auf den sich Argyros in seinem Brief an Gedeon bezieht, trotz gleicher Thematik nicht mit dem von ihm herausgegeben Brief I identisch ist, sondern etwas früher (XXVI versehentlich „later“) geschrieben wurde (XXVI–XXVIII). Die Datierung der „Appellatio“ auf die Zeit zwischen 1351 und 1354 (Sturz des Kantakuzenos) ist sicherlich richtig. Da Gregoras in seinen zweiten „Antirrhetikoi“ wie Dexios von der Nichtveröffentlichung des Tomos von 1351, der Unvollständigkeit der erworbenen Abschrift wie auch von der Gefahr spricht, durch den Herrscher ermordet zu werden (s. JÖB 36, 1986, 263 f. 276), ist laut meiner Datierung (s. JÖB 27, 1978, 146, Nr. 70) 1353 als wahrscheinliches Datum der Abfassung anzusehen. P. verfaßte eine bemerkenswerte Anmerkung zu Georgios von Pelagonia (XXXI f., A. 65). Die Identifizierung des Georgios Gabrielopulos mit Georgios, dem Philosophen, geht auf R.-J. LOENERTZ und F. TINNEFELD zurück, die mögliche Identifizierung des Georgios von Pelagonia mit Gabrielopulos auf mich (s. PLP II, Nr. 3433 und Talbot in ODB II 838 f., die PLP ausschreibt). Inzwischen bin ich zu dem Schluß gekommen, daß Georgios von Pelagonia, der an Akindynos Kritik übt, auf Grund seiner guten Informiertheit kein anderer sein kann als Akindynos, der wegen seiner Voreingenommenheit gegen Barlaam im Jahr 1341 Selbstkritik übt. Akindynos stammte aus der Region von Pelagonia. Möglicherweise ist er nach seiner Flucht aus Konstantinopel 1347 mit Hilfe Stefan Dušans sogar Bischof von Pelagonia geworden. (shrink)

These inscriptions were found by Georgios Sotiriadis in his excavation at the early byzantine of Agia Paraskévi in the south of Chaeronea. The precautionary principle holds that we should not allow scientific uncertainty to prevent us from taking precautionary measures in response to potential threats that are irreversible and potentially disastrous. Critics of the principle claim that it deters progress and development, is excessively risk-aversive and is unscientific. This paper argues that the principle can be scientific provided that (1) the threats addressed by the principle are plausible threats, and (2) the precautionary measures adopted are reasonable. The paper also argues that one (...) may use epistemic criteria, such as consistency, coherence and explanatory power, to determine whether a threat is plausible, and that one may use practical considerations, such as effectiveness, proportionality, cost-effectiveness, realism and consistency, to determine whether a response to a threat is reasonable. Brown famously held that in the field of public education, segregation has no place. But segregation was undefined. Was segregation constituted by mere racial classification, by the fact that the state had divided children into racial groups? Or did Brown condemn a caste system whose effect was to stigmatize black children. In Parents Involved v. Seattle Justice Roberts says segregation is about children not black children. This colorblind approach represents both a rewriting and appropriation of Brown in the service of (...) formalism. The Roberts court writes not only a new version of Brown but a new historical narrative about the meaning of segregation. The theme of this new story is formal equality - equality of opportunity only - as a universal ideal. This new story is woven entirely out of the language of Brown detached from all historical context. Conservatives have long canonized Brown. It has been a kind of second constitution for the second reconstruction. But how does this new story compare to the original understanding ?: Was this the evil that Brown denounced? By framing the issue in this way the paper seeks to make an end run around an impasse in our social and legal debate. Many progressive scholars have challenged the conservative conception of formal equality by suggesting alternative ways of thinking about it: anti-subordination models, a heightened call that equality should take issues of racial caste into account. But this external critique has stalled, perhaps in part because of the slippery indeterminacy of normative ideals. Segregation is far more determinate; it is something that has been concretized not only by the lived experience of black people, but by an earlier realist tradition on the part of the Warren court which saw it as it was. Retelling the two parts of this forgotten history we expose the disconnect between the Supreme Court's universalism and the actual meaning of segregation in context. Also, by focusing on the original understanding we seek a kind of internal critique showing how the politics of historical revision does not withstand the conservatives own interpretive approach.
